Okay, so there are a couple of challenges on the news page at Twisting the Hellmouth that caught my eye, and for maximum evil my personal purposes, I've decided to meld them into a personal challenge to myself. So, here goes:

EVERY DAY in November I will commit to write SOMETHING, whether it be a drabble or a one-shot or the start of something larger, based on prompts from YOU.

Here's how this will work:

The FIRST person to comment to this post leaves a FANDOM and a PROMPT WORD or PHRASE. For example, you might say "Buffy, howling at the moon." Then I will write something based on that prompt, and I will post it by the morning of November 1.

The FIRST person to comment to that post leaves another fandom and prompt, and I will write something for that, which I will post by the morning of November 2. And so forth.

HOPEFULLY if it all works out, by the morning of 30 November I will have posted a fic every single day. That's my plan, anyway.

As an additional incentive, in December I will try to write for any additional prompts that may be left by someone who is second or third to get in. And of course, if any of you are at all familiar with how I work, there's a good chance something bigger might come out of this. So try your luck! Roll my muse's dice and see what happens!

I have reopened all my fiction.

After studying the obscenity laws of the United States as they are applied under the First Amendment to the Constitution, I have learned the following:

First: Pornography is not illegal unless it is one of two things: child pornography or obscenity.

Child pornography is defined as follows by Title 18, Part 1, Chapter 110, Section 2256, Subsection 8 of the United States Code:

any visual depiction, including any photograph, film, video, picture, or computer or computer-generated image or picture, whether made or produced by electronic, mechanical, or other means, of sexually explicit conduct, where—
(A) the production of such visual depiction involves the use of a minor engaging in sexually explicit conduct;
(B) such visual depiction is a digital image, computer image, or computer-generated image that is, or is indistinguishable from, that of a minor engaging in sexually explicit conduct; or
(C) such visual depiction has been created, adapted, or modified to appear that an identifiable minor is engaging in sexually explicit conduct.

Text does not fall under the definitions of child pornography, BECAUSE there are NO ACTUAL/REAL MINORS in fictional text. I do not write child pornogrpahy.

Obscenity is a vague legal term defined only by application of the Miller Test for Obscenity, as follows:

For something to be "obscene" it must be shown that the average person, applying contemporary community standards and viewing the material as a whole, would find (1) that the work appeals predominantly to "prurient" interest; (2) that it depicts or describes sexual conduct in a patently offensive way; and (3) that it lacks serious literary, artistic, political or scientific value.

I hold and will continue to hold that my writing is NOT patently offensive, and that my writing contains serious literary merit. Being a reasonable person surrounded by reasonable people who feel the same way about my writing, I know this to be true.

Therefore, by posting my work on this public forum, I assert that I am violating no laws, and that if anyone chooses to restrict my right to post my work on this public forum where thousands of others post their work, that is a violation of the United States Constitution's First Amendment, which provides me the right of free speech.

The Establishment Clause DOES NOT APPLY. Precedent is set in Widmar v Vincent and other free expression lawsuits. If LiveJournal and SixApart provide a public forum for other people to post, then they are legally bound to allow me to post here as well, whether they like what I post or not.

All that being said, this journal is now open again and I will be posting here again. (Especially once NaNoWriMo is over.)
